Terms of Service
Review the terms and conditions for using The Picks Project.
Terms of Service
Last updated
1. The agreement
These terms are a contract between you and nineteen87 LLC ("we", "us"), an Illinois limited liability company and the operator of The Picks Project. They cover thepicksproject.com, our mobile app, and everything we offer through them (the "Service"). By creating an account or using the Service, you accept them. If you do not accept them, do not use the Service.
Our Privacy Policy and Cookie Policy explain what we do with your information, and form part of this agreement.
2. Who can use the Service
- You must be at least 13 years old. If you are under the age of majority where you live, you need a parent or guardian's permission.
- One account per person. Extra accounts distort leaderboards and survivor pools, which is the whole point of the game, so we treat them as a serious violation.
- You must not be barred from using the Service under any applicable law.
- You must give accurate information and keep it current.
3. Your account
Accounts are created by signing in with Google. We never receive your Google password, and keeping that Google account secure is your responsibility — anything done through it is treated as done by you. Tell us at support@thepicksproject.com if you believe someone else has access.
You can delete your account at any time from your profile page. Deletion is immediate and permanent, it removes your picks, activity, and pool memberships, and it deletes any pools you own along with everything in them. There is no undo, and we cannot restore a deleted account.
4. Free to play, and not a gambling service
The Service is free. We do not charge entry fees, we never take or hold money, we do not process payments, and we do not award prizes of any kind. Nothing here is a wager, and the Service is not a gambling, betting, sports betting, or daily fantasy platform.
You may not run gambling through the Service
Do not use the Service to organise, promote, advertise, or administer any pool involving entry fees, buy-ins, wagers, staking, or prizes — including collecting money outside the Service for a pool you run inside it. This is a rule we enforce, not a formality: accounts and pools used this way get removed.
If you nonetheless make any financial arrangement with other players, it is entirely between you and them. We are not a party to it, we take no responsibility for it, we will not mediate it, and depending on where you live it may be illegal. Our standings and scores are not an authority for settling any such arrangement.
5. Pools, picks, and scoring
How picks work
- A pick locks when its game kicks off. After kickoff you cannot make or change that pick, and we will not do it for you — not for a missed deadline, a mistaken pick, a lost connection, or a device that failed.
- Other players' picks stay hidden until kickoff, and yours stay hidden from them until then. Do not try to obtain another player's picks before they are revealed.
- Getting your picks in on time is your responsibility. Reminder emails are a courtesy, not a guarantee — they can be delayed, filtered, or not sent at all.
Pools
Anyone can create a pool and invite others with its join code. The person who creates a pool controls its settings, including its name, description, images, scoring configuration, and who is in it — and can delete it, which removes it for everyone in it. Joining someone's pool means accepting how they have set it up. Disputes inside a pool are for its members to resolve; we are not a referee, though we will act on anything that breaks these terms.
Scores and standings
Schedules, teams, and results come from a third-party sports data feed. That feed can be delayed, incomplete, or simply wrong, and so can our own scoring. We may recalculate scores, correct standings, void a competition, or adjust results at any time to fix an error, and corrections can change a leaderboard after the fact. Standings are provided for entertainment and must not be relied on for anything that matters.
6. Acceptable use
While using the Service, you agree not to:
- Create more than one account, or use anyone else's account.
- Cheat or manipulate outcomes — including collusion, coordinating accounts, exploiting a bug instead of reporting it, or interfering with another player's picks.
- Use bots, scrapers, or automation to submit picks, harvest data, or place unreasonable load on the Service.
- Probe, scan, or test the security of the Service, bypass authentication, or access accounts, data, or areas you are not authorised to reach. Found a vulnerability? Please report it to support@thepicksproject.com rather than exploiting it.
- Harass, threaten, impersonate, or abuse anyone, or post content that is obscene, hateful, or unlawful.
- Reverse engineer the Service, or copy, resell, or redistribute it.
- Break any applicable law, or use the Service in a way that causes us to break one.
7. What you post
You are responsible for what you put into the Service: your display name, username, location, pool names, pool descriptions, and any image URLs you supply for a pool's logo or banner. It must be yours to use, and it must not be offensive, misleading, or infringing.
You keep ownership of it. You grant us a non-exclusive, worldwide, royalty-free licence to store, display, and distribute it inside the Service for the purpose of operating the Service — nothing more. That licence ends when the content is deleted, except for copies in ordinary backups until they age out.
Remember that some of what you enter is visible to other players. Our Privacy Policy sets out exactly which parts.
We may remove content that breaks these terms, and we are not obliged to store or back up anything you post.
8. Intellectual property and trademarks
The Service, its design, and its code are ours or our licensors', and nothing in these terms transfers them to you. You may use the Service as intended, and that is the whole of the licence we grant.
We are not affiliated with, endorsed by, or sponsored by the National Football League, any NFL club, or any other sports league or team. Team names, logos, and league marks belong to their respective owners and are used only to identify the real-world games you are picking. Sports data is supplied by third parties who retain their own rights in it.
9. Third-party services
The Service depends on others — Google for sign-in, our hosting and database providers, our email provider, and a sports data feed. Their availability is not something we control, and an outage at any of them can take features down with it. Links to third-party sites are not endorsements, and what happens on them is governed by their terms, not ours.
10. Changes, suspension, and termination
The Service is free and offered as-is, so we may change, suspend, or discontinue any part of it, including features you rely on, and we may do so without notice. We will try to give warning for anything significant.
We may suspend or terminate your account, remove your pools, or void your results if you break these terms — immediately and without notice where the breach is serious, such as multiple accounts, cheating, gambling activity, or abuse of other players. Where it is proportionate to do so, we will tell you why and give you a chance to respond. You may stop using the Service and delete your account at any time, for any reason.
11. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free; that scores, standings, schedules, or statistics will be accurate or current; or that reminder emails or notifications will arrive. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost opportunities, or losses arising from any arrangement you make with another player.
Our total liability for any claim relating to the Service is limited to one hundred US dollars ($100). We think that is fair for something offered free of charge, and the free nature of the Service is part of the basis of this bargain. Nothing here limits liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence.
13. Indemnification
You agree to indemnify and hold us harmless from claims, damages, losses, and reasonable legal costs arising out of your use of the Service, your content, your breach of these terms, or any money arrangement you enter into with another player.
14. Governing law and disputes
These terms are governed by the laws of the State of Illinois, United States, where nineteen87 LLC is organised, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved between us goes to the state or federal courts located in the State of Illinois, and you and we each consent to their jurisdiction.
Please email support@thepicksproject.com first. Nearly everything is quicker to sort out that way.
15. General
- Changes to these terms. We may update them, and the date at the top of the page will change. For material changes we will give notice in the product or by email before they take effect. Continuing to use the Service after that means you accept the new terms.
- Severability. If a provision is unenforceable, the rest stays in force.
- No waiver. Not enforcing a provision once does not waive it.
- Assignment. You may not transfer your rights under these terms. We may transfer ours in connection with a merger, acquisition, or sale of the Service.
- Entire agreement. These terms, with the Privacy and Cookie Policies, are the whole agreement between us about the Service.
